Simply by refusing to issue an airworthiness certificate to a new one.<\/p>\r\n\r\n<p>On 16 September the FAA published a decision letting 35 more of them through anyway.<\/p>\r\n\r\n<p>It is an unglamorous document about certificates and dates. The United States adopted them. The mechanism is quiet and absolute: from 1 January 2028, a newly manufactured aircraft that does not meet the fuel-efficiency and CO2 limits cannot be issued its first certificate of airworthiness.<\/p>\r\n\r\n<p>No certificate, no delivery. No delivery, no sale. A production line does not get shut down by a regulator; it simply runs out of customers who can legally take the aircraft.<\/p>\r\n\r\n<p>The 777F is a derivative of a design that first flew in the 1990s, with the freighter itself flying in 2008. The problem is timing. The 777-8F was originally anticipated on the market in 2027. In October 2024 Boeing announced it was pushing the launch back to 2028, and said it would end 767F production in 2027 as well. Reuters has since reported the aircraft is not expected in service until around 2029.<\/p>\r\n\r\n<p>So Boeing filed for an exemption in December 2025, asking the FAA to decide by 1 May. The decision came in September. The language is characteristically dry.<\/p>\r\n\r\n\r\n<div style=\"background:#f8f9fa;border-left:4px solid #5C91FF;padding:20px 22px;margin:18px 0 24px;font-size:16px;line-height:1.7;display:flex;gap:20px;align-items:flex-start\"><div><em>&ldquo;This exemption goes into effect on January 1, 2028, and applies to issuance of the first certificates of airworthiness for up to thirty-five 777F airplanes through January 1, 2031, unless sooner superseded or rescinded.&rdquo;<\/em><div style=\"margin-top:10px;font-size:14px;color:#555\"><strong>Federal Aviation Administration<\/strong> &mdash; Exemption decision document, published 16 September 2026<\/div><\/div><\/div>\r\n\r\n\r\n<p>Thirty-five aircraft, three years, and a clause reserving the right to take it away. The FAA said it acknowledged the practical benefits of permitting limited 777F production until its successor is available, which is about as close as a regulator gets to saying we know this is awkward.<\/p>\r\n\r\n<h2 style=\"padding-top:22px\">Thirty-Five Is About One Year<\/h2>\r\n\r\n<p>Put the number in context. Boeing recorded 15 777 freighter orders and 35 777 freighter deliveries in 2025, and has delivered 18 so far in 2026. The exemption is therefore worth roughly a year of production at the recent rate, spread across three years of eligibility.<\/p>\r\n\r\n<p>Boeing told the FAA that more than $15 billion in American exports could be lost without it. The freighter shares that line, and the exemption is what keeps a version of it running past 2028.<\/p>\r\n\r\n<h2 style=\"padding-top:22px\">What It Says About Regulating Aviation<\/h2>\r\n\r\n<p>There is a temptation to read this as a climate rule being quietly gutted. It is not. The standard takes effect on schedule for everything else, the carve-out is capped at a specific number of airframes, and the window closes in 2031.<\/p>\r\n\r\n<p>What it actually illustrates is the mismatch between regulatory timetables and aerospace ones. ICAO set the 2028 date in 2017, eleven years ahead, which sounds generous. Boeing then needed a clean-sheet-ish freighter certified inside that window, and aircraft programmes slip. They always slip.<\/p>\r\n\r\n<p>The rule was right. The engineering was late.
