Welcome to the MiGFlug Referral Program (“Program”). These Terms and Conditions (“Terms”) govern your participation in the Program. By signing up and participating, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Definitions

  • MiGFlug: Refers to MiGFlug.com, Grüngasse 19, 8004 Zürich, Switzerland.
  • Affiliate: A business or individual that participates in the Program by promoting MiGFlug’s services.
  • Affiliate Link: A unique URL provided to the Affiliate for tracking bookings.
  • Commission: The €150 reimbursement per completed flight booking made through the Affiliate Link.
  • Portal: The online platform provided by MiGFlug for Affiliates to monitor bookings and commissions.

2. Eligibility

To participate in the Program, Affiliates must:

  • Be a legitimate business or individual operating within the legal jurisdiction.
  • Possess active media channels such as email, Instagram, Facebook, or other existing platforms.
  • Comply with all applicable laws and regulations.

3. Affiliate Registration

  • Sign-Up: Registration is free. Affiliates must complete the sign-up process on MiGFlug.com by providing accurate and complete information.
  • Credentials: Upon successful registration, Affiliates will receive a unique Affiliate ID and a PIN via email. These credentials are required to access the Portal.

4. Affiliate Portal

  • Access: The Portal provides a real-time view of bookings made through the Affiliate Link.
  • Security: Affiliates are responsible for maintaining the confidentiality of their Affiliate ID and PIN. Unauthorized access must be reported immediately to MiGFlug.

5. Promotion Guidelines

  • Authorized Materials: Affiliates may use descriptions and images publicly available on MiGFlug.com for promotional purposes.
  • Prohibited Practices:
    • Affiliates must not create or use their own brands or specific domains to promote MiGFlug’s offers.
    • All promotional activities must occur on the Affiliate’s existing media channels, such as email, Instagram, Facebook, etc.
  • Accuracy and Timeliness: Affiliates are responsible for providing accurate and timely information about MiGFlug’s offerings on their channels. Any misinformation or outdated details must be corrected promptly.
  • Compliance: Affiliates must ensure that all promotions comply with MiGFlug’s guidelines and do not misrepresent the services.

6. Updates to MiGFlug’s Offerings

  • Notification of Changes: MiGFlug will send updates regarding changes in offerings to Affiliates via email.
  • Action Required: Affiliates must implement any changes to their promotional content within 14 calendar days of receiving the update to ensure accurate representation of MiGFlug’s services.

7. Commission and Payment

  • Earning Commissions: Affiliates earn €150 for each completed fighter jet flight booking made through their Affiliate Link.
  • Payment Method: Commissions are paid via Tremendous.com using a one-time Visa or Visa card per booking.
  • Payment Delivery: Payments are sent to the email address provided during registration.
  • Payment Terms: Commissions are processed once the booked flight has taken place.

8. Termination

  • Right to Terminate: MiGFlug reserves the right to terminate any Affiliate agreement at any time without providing a reason.
  • Effect of Termination: Upon termination, any pending commissions for completed bookings remain owed to the Affiliate.
  • Notification: Affiliates will be notified via email upon termination of their participation in the Program.

9. Obligations of Affiliates

Affiliates agree to:

  • Provide Accurate Information: Ensure all information about MiGFlug’s offerings is accurate and up-to-date on their promotional channels.
  • Timely Updates: Act on any updates or changes to MiGFlug’s offerings within 14 calendar days of receiving notification.
  • Maintain Integrity: Promote MiGFlug’s services in a truthful and ethical manner, avoiding any misleading claims.
  • Compliance: Adhere to all applicable laws, regulations, and MiGFlug’s promotional guidelines.
  • Non-Exclusivity: Acknowledge that participation in the Program does not grant exclusivity, and MiGFlug may engage with other Affiliates.

10. Intellectual Property

  • Usage Rights: Affiliates are granted a non-exclusive, non-transferable right to use MiGFlug’s publicly available descriptions and images solely for promoting the Program.
  • Restrictions: Affiliates must not modify, sell, license, or distribute MiGFlug’s intellectual property without explicit written consent.

11. Limitation of Liability

MiGFlug shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program. MiGFlug’s total liability under these Terms shall not exceed the total commissions paid to the Affiliate in the preceding twelve months.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Canton of Zurich, Switzerland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Zurich.

13. Support

MiGFlug provides limited support to Affiliates, restricted to one (1) hour per month. Support requests should be directed via contact form available on migflug.com

14. Miscellaneous

  • Amendments: MiGFlug reserves the right to modify these Terms at any time. Affiliates will be notified of any changes via email.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: These Terms constitute the entire agreement between MiGFlug and the Affiliate regarding the Program and supersede all prior agreements and understandings.
